Terms and Conditions

  1. Validity: –

This tender is valid for a period of 30 Days from date of submission.

  1. Labour Agreement: –

Labour is priced as per Labour Relations Act (LRA).  Should you require site-specific labour rate, this will be subject to claim.

  1. Currency: –

All prices are quoted in South African Rands and all payments made must be in this currency.

  1. Payment Terms: –

Electro-Heat Energy (Pty) Ltd payment terms are strictly 30 days from date of invoice or otherwise negotiated

  1. Credit Check Application Form: –

This form must be completed and returned to the office for credit checks, an account to be opened and is available upon contract award

  1. Working Hours: –

Working hours as per respective Tender Submission / Quotation

  1. Limitation of Liability: –

We shall have no liability to the client for

  1. Any loss of profits or any consequential damages suffered by the client
  2. Any claim not expressly defined and provided for in the contract with the Client.
  3. Notwithstanding anything containing in this contract, our liability for damages however so caused, shall not exceed three percent of the contact price.

  1. Delay Claims: –

Any unproductive time being no fault of Electro-Heat Energy (Pty) Ltd, will be subject to claim.

  1. Physical Order / Contract / Task Order: –

No work will be executed without a written physical task order / contract

  1. Lead Time & Availability of Resources: –

Electro-Heat Energy (Pty) Ltd would require a lead time as prescribed by the quotation / tender submission for the resourcing and planning based on client requirements & Access Parameters or as other stipulated in the respective Tender Submission / Quotation. This bid is additionally centred on the availability of resources at the time of submission and project start & completion dates supplied on the enquiry.

  1. Value Added Tax (VAT): –

The respective Tender Submission / Quotation is exclusive of VAT, this will be subject to claim when billing.

  1. Laydown Area: –

It will be the client’s responsibility to provide a secured laydown area not more than 500m away from the activity area and this should include for Electrical and Plumbing provisions.

  1. Construction Programme: – (where applicable)

It is essential that we have an agreed program signed by both parties prior to the commencement of work. This will enable Electro-Heat to manage the contract both economically and efficiently to ensure that our services are supplied

on time as required.  Should our workmen lose man hours or there is a lack of job continuity arising from events beyond our control but under your jurisdiction, the unproductive hours will be subject to claim.

In conjunction with yourselves Electro-Heat will agree to a practical working programme, based on the scope into logical packages, the build-up of the programme will take into account the following factors:-

  1. Key date requirements per activity prior to the commencement of work
  2. Programme release dates per item
  3. Electro-Heat’s Optimization of resources

 

  1. Scaffold platform loading: –

Electro-Heat Energy to provide working platforms to withstand a load including men and material of 160kg per m2

  1. Scaffold Ties: –

Electro-Heat Energy urges the client / end user to read and carefully understand submitted scaffold Handover Certificates that draws attention to scaffold ties. Openings for ties & to ensure weather-proofing on completion will be the client/end user’s respective responsibility.

  1. Additional Work: –

All work outside this scope of work will be subject to claim based on our signed access certificate

  1. Retention: –

This bid is not subject to retention as scaffolding does not constitute a permanent structure.

  1. Force Majeure: –

Strikes, Plant stand down and inclement weather cost being no fault of Electro-Heat will be subject to claim.
